We are aware of those risks and constantly trying to improve in that regard.

As we did not change anything regarding that in the installer from the former one it might be a bug in ubiquity alltogether. As Mint also uses Ubiquity as installer do you know if it also suffers from this issue.
Usually I agree the installer should not format this partition if it isn't setup to be formatted.
We will keep an eye on it and see if it is reproducable.
